Terms of Service.

By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site. You must be at least 18 years old and legally capable of entering an agreement. If you use the Site on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

The Site provides general information about Loskutech, its process, capabilities, service areas, public starting prices, and examples of work. Site content is not legal, financial, tax, accessibility, security, or other regulated professional advice. It is not a promise that a particular service, timeline, result, platform, integration, or price is available for your project.

Submitting a form, sending an email, or participating in an introductory conversation does not create a client relationship, fiduciary relationship, partnership, exclusivity obligation, or duty to accept a project.

A paid engagement begins only when the applicable parties accept a written agreement and any stated payment or onboarding conditions are satisfied. That agreement defines scope, deliverables, fees, billing, approvals, dependencies, ownership, licenses, support, service levels, change control, termination, and other project-specific terms. If these Terms conflict with an executed project or service agreement, that agreement controls for the paid services it covers.

Public prices and plan descriptions are starting points for the stated scope, not binding quotes. Final pricing and availability depend on requirements, content, integrations, migration risk, third-party costs, timing, taxes, and other project facts. A proposal may expire or be changed before acceptance. Loskutech may decline an inquiry or recommend a different next step.

You are responsible for information you submit through the Site. You represent that it is accurate to the best of your knowledge, that you are authorized to provide it, and that doing so does not violate another person’s rights or an obligation of confidentiality. Do not send credentials, payment-card information, government identifiers, medical information, or other sensitive data through an ordinary Site form.

You authorize Loskutech to use submitted information to evaluate and respond to your request, operate and secure the Site, maintain appropriate business records, and take other actions described in the Privacy Policy. We do not guarantee that every submission will receive a response or result in an engagement.

You may use the Site only for lawful purposes and in accordance with these Terms. You may not:

• Use the Site to violate law, infringe rights, misrepresent your identity or authority, or submit unlawful, deceptive, abusive, or harmful material.
• Probe, scan, or test vulnerabilities; bypass access, rate-limit, or anti-spam controls; or attempt unauthorized access to the Site, its infrastructure, or associated data.
• Introduce malware, malicious code, destructive content, or automated traffic that interferes with the Site or creates an unreasonable operational burden.
• Scrape, harvest, copy, or republish Site content at scale, or use automated means to access the Site, except for ordinary search-engine indexing or with prior written permission.
• Reverse engineer a non-public Site feature, remove rights notices, frame the Site in a misleading manner, or imply endorsement or affiliation without permission.
• Use information obtained from the Site to send spam, conduct fraud, or harm Loskutech, its clients, providers, or other users.

The Site and its original text, design, code, graphics, branding, illustrations, and arrangement are owned by Loskutech or used with permission and are protected by applicable intellectual-property laws. Loskutech grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for your own lawful evaluation of Loskutech services. No other right or license is granted by implication.

Client names, logos, screenshots, and other third-party materials remain the property of their respective owners and may be shown under permission or another lawful basis. You may not use Loskutech names, marks, or brand assets in a way that suggests sponsorship, endorsement, or affiliation without written permission.

If you voluntarily provide general feedback or suggestions about the Site, you grant Loskutech a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or compensation. This does not transfer ownership of confidential business materials supplied for a potential or active project.

The Site may link to or embed services operated by third parties, including maps, analytics, anti-spam, scheduling, hosting, or other providers. Loskutech does not control their content, availability, security, or practices and is not responsible for them. Your use of a third-party service may be governed by that provider’s terms and privacy policy.

Our Privacy Policy explains how we handle personal information collected through the Site and is incorporated into these Terms. Privacy choices available through the Site do not change data-processing terms in a separate client service agreement.

We may change, suspend, restrict, or discontinue any part of the Site at any time. We do not guarantee uninterrupted, error-free, secure, or permanently available access. We may correct errors and update content without notice, but we are not obligated to update every reference immediately.

To the fullest extent permitted by law, the Site is provided "as is" and "as available." Loskutech disclaims all warranties regarding the Site, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and security. Loskutech does not warrant that Site content will produce a particular business, search, advertising, accessibility, security, or financial outcome.

To the fullest extent permitted by law, Loskutech and its members, personnel, contractors, and providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising from or related to the Site or these Terms, even if advised of the possibility of those damages.

To the fullest extent permitted by law, Loskutech’s total liability arising from or related to the Site or these Terms will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid Loskutech specifically for access to the Site during the twelve months before the event giving rise to the claim. Separate limits in an executed project or service agreement govern claims arising from paid services. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Loskutech and its members, personnel, contractors, and providers from third-party claims, damages, liabilities, costs, and reasonable attorneys’ fees arising from your unlawful use of the Site, your violation of these Terms, or information you submit in violation of another person’s rights. This obligation does not apply to the extent a claim results from Loskutech’s own unlawful conduct.

We may restrict or terminate your access to the Site if we reasonably believe you violated these Terms, created risk or potential legal exposure, or interfered with Site operation. Provisions that by their nature should survive termination will survive, including provisions concerning intellectual property, disclaimers, liability, indemnification, and governing law.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Unless an applicable law requires otherwise, any dispute arising from the Site or these Terms must be brought exclusively in the state or federal courts located in Los Angeles County, California, and each party consents to their jurisdiction and venue.

We may update these Terms when the Site, our practices, or legal requirements change. We will post the revised Terms here and update the date above. Material changes apply prospectively unless a different result is required by law. By continuing to use the Site after revised Terms take effect, you agree to the revised Terms.

These Terms and the Privacy Policy are the entire agreement concerning public use of the Site and replace prior discussions on that subject. If a provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; Loskutech may assign them as part of a reorganization, transaction, or transfer of the Site or business.
